Update to Expert's Declaration - Criminal

05-04-2017

The fourth amendment to the Criminal Practice Directions 2015 ([2016] EWCA Crim 1714 [1]) took affect on 3rd April 2017. It was handed down by the Lord Chief Justice on 28th March 2017.

This update provides amendments to existing Criminal Practice Directions and supplements the Criminal Procedure (Amendment No. 2) Rules 2017, S.I. 2017/144 that come into force on 3rdApril 2017.

In particular Expert Witnesses should take note of a change to the Declaration.

In CPD V Evidence 19B: STATEMENTS OF UNDERSTANDING AND DECLARATIONS OF TRUTH IN EXPERT REPORTS the amendment makes it clear that the code of practice or conduct to be followed by experts when signing a declaration on a report made available for the court, should be the code of practice or conduct relevant to that individual expert.

The relevant section of the Declaration is paragraph 13 which should now read as follows:

13. I confirm that I have acted in accordance with the code of practice or  conduct for experts of my discipline, namely [identify the code]

The Academy of Expert's Declaration has been updated to reflect the change and can be found, along with other Declarations HERE along with guidance on how to comply with the updated Declaration.
